At the beginning of 2024, the Joint Committee of the European Supervisory Authorities (ESAs) will once again examine the functionality of the Securitisation Regulation. The ESA reports are important guides: The first report on the EU Securitisation Regulation in accordance with Article 44 was published in May 2021 (see TSI kompakt). The European Commission’s report on the functioning of the Securitisation Regulation from October 2022 built on this report. The European Commission’s report provided important findings and identified potential for improvement (for details, see TSI kompakt October 2022) – however, no adjustments have been made so far.
The regular revision of the Article 44 report is now on the Joint Committee’s agenda for 2024. The supervisory authorities are now calling for a targeted consultation of market participants in advance. They are asking for a wide range of feedback – from the general functioning of the Securitisation Regulation and STS to green securitisations and internal bank processes.
The consultation offers an important opportunity to comment and make suggestions for improvement, particularly in view of the upcoming EU parliamentary elections and the working agenda of the new Commission. TSI will therefore coordinate a response and welcomes contributions from market participants.
The deadline for feedback on the consultation is 30 January 2024.
