The European Single Access Point (ESAP) is European law since 9 January. This centralised European access portal will gradually make relevant company data, including sustainability information, publicly available at a central data hub for market participants by summer 2027. ESMA will be responsible for managing this free, centralised and digital access to public financial and non-financial information on companies in the EU.
The idea for a central European access portal stems primarily from recommendations made by the High Level Forum (HLF) on the Capital Markets Union (CMU) in June 2020 (see TSI kompakt, 19 June 2020). The aim is to make companies more visible to investors and promote transparancy across capital markets.
The ESAP was established by Regulation (EU) 2023/2859. In addition, an amending regulation (Regulation (EU) 2023/2869) and an amending directive (Directive (EU) 2023/2864) were adopted in parallel to adapt numerous EU legal acts in which reportable information is located. The member states must transpose the amending directive into national law by 10 January 2026.
The further process of setting up the ESAP by ESMA and ESMA’s consultation on the disclosure templates for securitisations (see TSI kompakt, 8 January 2024) will continue to run separately.
